1. OVERVIEW
Testa Seat Inc. ("we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, and share information when you visit or make a purchase from testa-seat.com (the "Site").
2. PERSONAL INFORMATION WE COLLECT
When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support.
A. Device Information (Automatically Collected)

C. Customization & Measurement Data (Critical)

Examples: Body measurements (hip width, seat depth, trunk height, etc.), weight, age of the user, and any specific notes regarding physical requirements provided for the custom manufacturing of the seat.

Purpose: To design, manufacture, and verify the fitment of your custom Postural Support Device.

Storage: This data is stored securely and linked to your order history to facilitate future re-orders or adjustments.
3. MINORS
The Site is not intended for individuals under the age of 18. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address below to request deletion.

4. HOW WE USE YOUR PERSONAL INFORMATION

By consenting to Testa Seat’s SMS marketing in the checkout and initializing a purchase or subscribing via our subscription tools, you agree to receive recurring text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us, even if your mobile number is registered on any state or federal do-not-call list.

8. YOUR RIGHTS (GDPR & CCPA)

9. DATA RETENTION
When you place an order through the Site, we will maintain your Order Information and Measurement Data for our records unless and until you ask us to delete this information. We retain measurement data specifically to assist you with future orders or adjustments as the user grows.

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.

Governing Law: State of Delaware (U.S.A.)
Venue/Jurisdiction: State and federal courts located in Delaware, unless otherwise required by law.
IMPORTANT REVIEW NOTICE
This document is provided for review and reference only. It is not intended to be separately signed.
The final Recipient information, selected tier, shipping terms, pricing, replacement value, and other order-specific details will be based on the applicable website order, checkout record, invoice, shipping record, or written order confirmation.
By placing an order, requesting a Kit, paying an invoice, accepting shipment, or otherwise taking possession of or using the Kit, Recipient agrees to these Terms.
Effective Date
These Terms take effect on the earliest of:
(a) the date Recipient places an order,
(b) the date Recipient requests the Kit,
(c) the date Recipient pays an invoice related to the Kit, or
(d) the date Provider ships the Kit.
Parties
These Terms are between:
Testa-Seat, Inc., a Delaware corporation (“Provider”), with principal place of business in Pittsburgh, Pennsylvania; and the individual or organization identified in the applicable order, checkout, invoice, shipping record, or written order confirmation (“Recipient”).
Order Record Controls
The following details will be determined by the applicable order or order record and are incorporated into these Terms by reference:
- Recipient legal name
- Recipient billing and ship-to address
- Primary contact name, email, and phone
- Trial length, if applicable
- Shipping responsibility
- Any approved extensions or special terms confirmed by Provider in writing
1. Purpose
Provider supplies seating trial equipment to Recipient solely for evaluation and demonstration to help families assess comfort, posture, and day-to-day participation prior to purchase or rental. Recipient may also evaluate the seats to improve session outcomes when appropriate positioning is achieved.
2. Definitions
“Kit” means Provider’s professional kit, including the components listed in Appendix A, unless otherwise specified in the order record.
“End User” means any family, patient, or client using the Kit outside Provider’s direct control.
“User Manual” means Provider’s official User Instructions Manual, available online. Recipient agrees to refer to the most current version available at the Manual URL.
“Normal Wear and Tear” means cosmetic or minor wear consistent with ordinary trial use, excluding breakage caused by misuse, negligence, improper setup, unauthorized modification, or use inconsistent with the User Manual.
“Incident” means any event involving injury, near-injury, tipping, component failure, or any safety-related concern during use.
3. User Manual Controls
Recipient agrees that:
- the User Manual forms part of these Terms by reference; and
- the Kit must be used only as permitted in the User Manual and Provider instructions.
If there is any conflict between informal guidance, including social media or third-party guidance, and the User Manual, the User Manual controls.
The applicable User Manual for compliance is the version in effect at the time of use. For any Incident, the governing manual is the version available at the Manual URL on the date of the Incident, or the version provided at checkout if later proven.
4. Tier Selection
The applicable tier will be the tier selected after receiving the trial. If no tier is clearly selected or confirmed, Tier 1 applies by default.
Tier 1 — Order, Trial & Return (Single-Child | Low Caseload)
Scope: One identified End User.
Trial Term: 30 days from delivery, unless otherwise stated in the order record.
Cost: Trial is $0, unless otherwise stated in the order record.
Shipping: As stated in the order record.
Return: Recipient must return the Kit by the due date using Provider’s return instructions and return all components in reasonably similar condition, Normal Wear and Tear excepted.
Tier 2 — Rolling Professional Trial (Slow Caseload)
Term: 30 days from delivery, with possible 30-day extensions based on utilization.
Check-in: Provider and Recipient may check in near days 25 to 28.
Extensions: At Provider’s discretion if there is ongoing demand, including trials, session usage, orders, rentals, or waitlist activity.
Shipping/Return: As stated in the order record or later confirmed by Provider in writing.
Tier 3 — Purchase + Affiliate Program
Purchase Price: As stated at checkout, in the invoice.
Family Discount: May vary from time to time and may be issued via Recipient-specific code or link.
Recipient Commission: If applicable, commission terms will be based on the applicable affiliate arrangement, code, link, or written confirmation from Provider.
Payout Timing: Unless otherwise stated in writing, monthly, Net 30, via ACH or approved digital payment method, subject to required tax documentation.
Kit Ownership: Recipient owns the Kit upon full payment, subject to any applicable warranty terms.
Core Terms Applicable to All Tiers
5. Trial Term, Extensions, and Non-Return

The trial term begins on the delivery date shown by the carrier, unless otherwise specified in the order record.

Extensions must be requested in writing and are granted at Provider’s discretion.
-
If a non-purchased Kit is not returned within 15 calendar days after the trial ends or after termination, Provider may invoice Recipient for the applicable replacement value or non-return amount stated in the order record, plus any unpaid fees.
-
If no different amount is stated in the order record, Provider may invoice Recipient for replacement value of $690.
6. Warranty During Trial

If a seat breaks under normal use, Provider will repair or replace it at Provider’s discretion.

This warranty does not cover damage resulting from misuse, neglect, improper setup, unauthorized modification, or use inconsistent with the User Manual.
7. Proper Use and Recipient Duty to Inform
When the Kit is used in a supervised setting or loaned to an End User, Recipient agrees to:
-
Provide a basic orientation on setup, adjustments, safe use, and care consistent with Provider guidance;
-
Direct End Users to the User Manual and provide the Manual URL and/or QR code and safety notices;
-
Clearly communicate that the Kit is for trial or evaluation and outcomes are not guaranteed;
-
Communicate any required supervision and prohibited uses stated in the User Manual; and
-
Refer any questions beyond basic operation to Provider support and/or appropriate licensed professionals.
Recipient will not remove safety labels, alter the Kit, or provide instructions that contradict the User Manual.
8. Use Outside Recipient’s Immediate Setting
If the Kit is loaned outside Recipient’s immediate setting:
-
Recipient must provide End User or guardian with the applicable family loan terms before take-home use;
-
Recipient must track check-out and check-in dates and components issued and returned; and
-
End Users must be instructed to review the User Manual before use and contact Recipient, and Provider if needed.
Provider is not liable for damages or injuries arising from use outside Provider’s control, except as required by applicable law.
9. Care, Maintenance, Inspection, and Cleaning
Recipient will keep the Kit clean and in good condition and follow the User Manual guidance for inspection and cleaning.
Recipient will:

Inspect the Kit before each use or loan;
-
Confirm straps, buckles, and parts are secure; and
-
Stop use if any concern exists.
Recipient will use only recommended cleaning methods and no harmful solvents or abrasives.
10) Safety Incident Reporting
Recipient must notify Provider of any Incident within 24 hours, or the next business day if after hours, and immediately stop using the Kit until Provider confirms next steps.
Recipient will preserve the condition of the involved components, will not repair or modify them, and will provide photos and a brief description.
11. Component Tracking and Chain of Custody
Recipient agrees to maintain a simple log for each checkout that includes:

12. Checkout/Return Checklist Requirement
Recipient will use Provider’s checklist at:

Initial setup,
-
End User checkout, and
-
End User return
This is intended to reduce missing parts and confirm that safety instructions were provided.
13. Family Deposit / Fees Policy
If Recipient collects a refundable deposit or other fees from families, Recipient must:

Disclose the policy in writing or electronically to the family before checkout; and
-
Ensure the policy does not contradict these Terms or the User Manual.
Provider does not collect deposits from families through Recipient unless explicitly agreed in writing.
14. Safety and Medical Disclaimer

The Kit is provided for evaluation and demonstration only.
-
Provider does not provide medical advice through the Kit alone and makes no guarantee of clinical outcomes, reimbursement, or suitability beyond what is stated in the User Manual.
15. Liability; Assumption of Risk; Indemnification
The Kit is used at Recipient’s and End Users’ own risk.
To the maximum extent permitted by law, Provider disclaims liability for injuries, damages, or losses arising from use of the Kit, except to the extent caused by Provider’s gross negligence or willful misconduct, where applicable.
Recipient agrees to defend, indemnify, and hold harmless Provider from claims arising out of:
(a) Recipient’s improper setup or instructions,
(b) misuse, neglect, or unauthorized modification,
(c) failure to provide the User Manual and safety guidance,
(d) use outside intended purpose, or
(e) Recipient’s breach of these Terms.
16. Limitation of Liability

Provider’s total liability related to these Terms is limited to the amounts paid by Recipient to Provider for the Kit in the prior 12 months, or $690, whichever is less.

Provider is not liable for indirect, incidental, special, consequential, or punitive damages.
17. Insurance
Recipient is encouraged to maintain general and/or professional liability insurance customary for its services and will provide a certificate of insurance upon request, if available.
18. Map Listing and Privacy
Recipients that trial the seat may be listed on Provider’s map so families can request advice.
Recipient may opt out or request removal.
Recipient will not share patient-identifying information with Provider without proper authorization.
19. Termination

Either party may terminate with 15 days’ written notice.
-
Provider may require immediate return if safety concerns arise or if these Terms are breached.
-
Upon termination, any non-purchased Kits must be returned within 10 calendar days unless Provider agrees otherwise in writing.
20. Governing Law; Venue; Attorneys’ Fees

Delaware law governs.
-
Disputes must be brought in state or federal courts in Delaware, unless otherwise required by law.
-
The prevailing party may recover reasonable attorneys’ fees and costs to the extent permitted by law.
21. Entire Agreement; Severability; Amendments; Acceptance Without Signature

These Terms, together with any applicable appendices, order records, checkout records, invoices, shipping confirmations, and written Provider-approved business terms, are the entire agreement between the parties regarding the Kit.

If any provision is unenforceable, the remaining provisions remain in effect.

Provider may update these Terms from time to time for future orders. The version applicable to Recipient is the version provided for review or made available at or before the applicable order, request, invoice payment, or shipment.

No separate handwritten or standalone electronic signature is required for these Terms to be binding.
-
Recipient accepts these Terms by placing an order, requesting a Kit, paying an invoice, accepting shipment, taking possession of the Kit, or using the Kit.
Appendix A — Kit Contents
Unless otherwise specified in the applicable order record, the Kit may include:
- Shell Petit
- Shell Small
- Shell Medium
- Headrest Set
- Shoulder Harness
- Footrest / Anti-tipping set
Appendix B — Family Take-Home Loan Terms
If Recipient loans the Kit to a family for take-home use, Recipient must provide family-facing loan terms before release of the Kit.
Recipient may collect acknowledgment of those terms through its normal process, including signed form, electronic acceptance, checkout form, or written confirmation.
At a minimum, the family-facing terms should state that:
1. The equipment is provided for trial or evaluation use only;
2. The User Manual must be read and followed before and during use;
3. Appropriate supervision is required during use;
4. The equipment may not be modified, disassembled, or repaired by the family;
5. The family must perform a basic safety check before each use;
6. Any Incident must be reported within 24 hours and use must stop until next steps are provided;
7. All components must be returned by the due date, subject to any disclosed replacement or missing-item policy; and
8. Take-home use occurs outside Provider’s supervision and at the family’s own risk to the maximum extent permitted by law.
